Terms of Service
The following terms of service are terms of a legal agreement (the “Agreement”) between you (“you”, “your”, or “user”) and POETRYYFINANCE Inc., its subsidiaries, affiliates, agents and assigns (“POETRYYFINANCE.”, “we”, “us”, or “our”) which sets forth the terms and conditions for your access and use of POETRYY FINANCE application (“POETRYY FINANCE App”) and POETRYYFINANCE website, as well as the POETRYY FINANCE products and services offered, operated, or made available by POETRYY FINANCE through the POETRYY FINANCE Application(collectively, the “POETRYY FINANCE Services”).
The POETRYY FINANCE App, website and POETRYYFINANCE Services are owned and operated by POETRYY FINANCE, and are being provided to you expressly subject to this Agreement. By accessing, browsing and/or using POETRYY FINANCE Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement, POETRYY FINANCE Privacy Policy, which may be found by visiting POETRYY FINANCE Privacy Policy and that you agree to comply with all applicable laws and regulations. In addition, by agreeing to this Agreement and POETRYY FINANCE Privacy Policy, you also agree to Mbanq’s Privacy Policy, which may be reviewed by visitinghttps://www.mbanq.com/legal. The terms and conditions of this Agreement form an essential basis of the bargain between you and POETRYY FINANCE, and this Agreement governs your use of the POETRYY FINANCE App, and the POETRYY FINANCE Services.
This Agreement does not apply to Customer Account and Cardholder Agreement (the“Bank Services”), each of which are provided by EVOLVE BANK & TRUST, Member FDIC (“[Evolve”).The POETRYY Account and POETRYY Card are subject to and governed byyour Customer Account and Cardholder Agreement with Evolve. Please refer to theEvolve’s Customer Account and Cardholder Agreement for further information concerning the Bank Services and your privacy rights concerning the BankServices, which may be accessed
by visiting https://www.getevolved.com/privacy-policy/.Evolve is not a to party this Agreement
and is neither responsible or liable for the POETRYYFINANCE Services provided by POETRYY FINANCE or Mbanq pursuant to thisAgreement or any other agreement you may have with POETRYY FINANCE.
THISAGREEMENT ALSO INCLUDES, AMONG OTHER THINGS, A BINDING ARBITRATION PROVISION
THATCONTAINS A CLASS ACTION WAIVER. PLEASE REFER TO SECTION 13 BELOW FOR MORE
INFORMATION.
